3. General Principles
3.1 What data do we collect from you and from whom do we receive it?
Primarily, we process personal data that you provide to us or that we collect during the operation of our website. In some cases, we may also receive personal data about you from third parties. Possible categories include:
- Personal details (name, address, date of birth, etc.)
- Contact details (mobile number, email address, etc.)
- Financial data (e.g., account information)
- Online identifiers (e.g., cookie ID, IP addresses)
- Location and traffic data
- Audio and visual recordings
- Special categories of data (e.g., biometric data or health-related information)
-
3.2 Under what circumstances do we process your data?
We treat your data confidentially and process it only for the purposes set out in this privacy policy. We ensure transparent and proportionate processing.
If, in exceptional cases, we are unable to comply with these principles, the processing of your data may still be lawful if there is a legal basis for doing so, such as:
- Your consent
- The performance of a contract or pre-contractual measures
- Our legitimate interests, provided your interests do not override them
-
3.3 How can you withdraw your consent?
If you have given us consent to process your personal data for certain purposes, we will process your data within the scope of that consent unless we have another legal basis.
You may withdraw your consent at any time by sending an email to the address stated in the imprint. Data processing carried out before the withdrawal is not affected.
3.4 In which cases may we disclose your data to third parties?
a. General
We may need to use the services of third parties or affiliated companies and engage them to process your data (so-called processors). Categories of recipients may include:
- Accounting, fiduciary, and auditing companies
- Consulting firms (legal, tax, etc.)
- IT service providers (web hosting, support, cloud services, website design, etc.)
- Payment service providers
- Providers of tracking, conversion, and advertising services
We ensure that these third parties and our affiliated companies comply with data protection requirements and treat your personal data confidentially.
In some cases, we may also be legally obliged to disclose your personal data to authorities.
b. Visiting our social media channels
Our website may include links to our social media channels. You can identify these links (typically via corresponding icons). If you click these icons, you will be redirected to our social media channels.
The social media providers will then know that you are accessing their platform from our website. They may use this data for their own purposes. We have no knowledge of the content of the transmitted data or how it is used by the providers.
c. Transfers abroad
In the course of processing, your personal data may be transferred to companies abroad. These companies are required to protect your data to the same extent as we do. Transfers may occur worldwide.
If the level of data protection is not equivalent to that in Switzerland, we will carry out a prior risk assessment and ensure contractually that the same protection is guaranteed (e.g., using the EU Commission’s standard contractual clauses or other legally required measures). If our risk assessment is negative, we will implement additional technical measures to protect your data.
You can access the EU Commission’s standard contractual clauses here:
https://commission.europa.eu/publications/standard-contractual-clauses-controllers-and-processors-eueea_en
3.5 How long do we store your data?
We store personal data only as long as necessary to fulfill the purposes for which it was collected.
Data collected during your visit to our website is retained for twelve months. An exception applies to analytics and tracking data, which may be retained for longer.
Contract-related data is stored longer due to legal obligations — business correspondence, concluded contracts, and accounting records must be retained for up to 10 years. When such data is no longer needed to provide our services, it will be locked and used solely for accounting and tax purposes.
3.6 How do we protect your data?
We store your data securely and take all reasonable measures to protect it from loss, unauthorized access, misuse, or alteration.
Our contractors and employees with access to your data are bound by confidentiality and data protection obligations. In some cases, we may need to forward your request to affiliated companies — even then, your data will be treated confidentially.
We use SSL (Secure Socket Layer) encryption on our website, in conjunction with the highest encryption level supported by your browser.
3.7 What are your rights?
a. Right of access
You may request information about the personal data we hold about you at any time. Please send your request together with proof of identity to dirk@bahrenburg.design.
You also have the right to receive your data in a commonly used file format if we process it automatically and if:
- You have consented to the processing, or
- You provided the data in connection with the conclusion or performance of a contract
-
We may restrict or refuse disclosure if it conflicts with our legal obligations, legitimate interests, public interests, or the interests of third parties.
We aim to respond to your request within the legal 30-day deadline, but this may be extended if we receive a high volume of requests, require legal or technical clarification, or need further details from you. You will be informed of any extension in due time.
b. Deletion and rectification
You can request the deletion or correction of your data at any time. We may reject such a request if legal obligations require us to retain it or if there is another legal basis for its retention.
Please note that exercising your rights may conflict with contractual agreements and affect the performance of the contract (e.g., early termination or cost implications).
c. Legal remedies
If you are affected by the processing of personal data, you have the right to take legal action or lodge a complaint with the competent supervisory authority.
The competent authority in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC):
